1. Agreement to these terms
These Terms & Conditions ("Terms") govern your use of www.americlublabs.com (the "Site") and any purchase of products from AMERICLUB ("AMERICLUB," "we," "us," or "our"). By accessing the Site or placing an order, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.
2. Research use only
All products sold by AMERICLUB are intended solely for in-vitro laboratory research by qualified individuals. Products are not drugs, foods, dietary supplements, or cosmetics. They are not intended to diagnose, treat, cure, or prevent any disease, and they are not for human or veterinary use.
By purchasing, you represent and agree that you will:
- use products only for lawful laboratory research;
- not administer, or allow anyone else to administer, any product to humans or animals;
- handle, store, and dispose of products according to accepted laboratory safety practices and all applicable laws; and
- not resell products for human or animal use or misrepresent their intended use.
AMERICLUB does not provide dosing, administration, or medical guidance. We may refuse or cancel any order if we believe products may be used in violation of these Terms.
3. Eligibility
You must be at least 21 years old, and legally able to enter into a binding contract, to use the Site or purchase products. By using the Site, you confirm that you meet these requirements and that purchasing these products is lawful where you are located.
4. Orders and acceptance
Online ordering is not yet available. Once it opens, submitting an order is an offer to purchase. We may accept or decline any order, in whole or in part, at our discretion, including orders that appear to violate these Terms, exceed quantity limits, or contain errors. An order is accepted only when it ships. We may limit quantities per item or per customer.
5. Pricing and payment
Prices are listed in U.S. dollars and may change without notice. We make reasonable efforts to display accurate pricing and product information. If an error occurs, we may correct it and cancel affected orders, with a full refund of any amount paid. Payment is processed by third-party payment providers, and you agree to their terms when paying. Applicable taxes and shipping charges will be shown before you place your order.
6. Shipping
We ship to addresses within the United States, subject to applicable laws. Delivery times are estimates and are not guaranteed. Title and risk of loss pass to you when products are delivered to the carrier. You are responsible for providing an accurate shipping address and for complying with any laws that apply to receiving products at your location.
7. Returns and refunds
Because of the nature of research materials, we cannot accept returns of products that have been opened or that have left our control, except as described here. If your order arrives damaged, defective, or incorrect, contact us at americlublabs@gmail.com within 7 days of delivery with your order number and photos. We will replace the item or issue a refund at our discretion. Orders may be changed or canceled before they ship by contacting us as soon as possible.
8. Product information
Product descriptions, specifications, and images are provided for identification and informational purposes. Certificates of Analysis, where available, are provided on request for the applicable lot. Vial images on the Site are representative and may differ from the product you receive.
9. Disclaimer of warranties
Except as expressly stated in these Terms, the Site and all products are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. AMERICLUB makes no warranty regarding the results that may be obtained from using any product in research.
10. Limitation of liability
To the fullest extent permitted by law, AMERICLUB and its owners, employees, and suppliers are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or any product, including any use that violates these Terms. Our total liability for any claim relating to a product will not exceed the amount you paid for that product.
11. Indemnification
You agree to indemnify and hold harmless AMERICLUB and its owners, employees, and suppliers from any claims, damages, losses, and expenses, including reasonable attorneys' fees, arising from your misuse of any product, your violation of these Terms, or your violation of any law or the rights of a third party.
12. Use of the Site
You agree not to misuse the Site, interfere with its operation, attempt to gain unauthorized access, or use it for any unlawful purpose. All content on the Site, including text, graphics, logos, and images, is owned by AMERICLUB or its licensors and may not be copied or used without our permission.
13. Governing law
These Terms are governed by the laws of the United States and of the state in which AMERICLUB is organized, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in that state, and you consent to their jurisdiction.
14. Changes to these terms
We may update these Terms from time to time. When we do, we will change the "Last updated" date at the top of this page. Continuing to use the Site after changes are posted means you accept the updated Terms.
